The IDR 300,000
fee represents our service fee only and does not include official government
fees (PNBP) imposed by the Ministry of Law and Human Rights of the Republic of
Indonesia through the Directorate General of Intellectual Property (DJKI).
A Trademark is a sign that can be graphically represented in the form of images, logos, names, words, letters, numbers, color arrangements, two-dimensional and/or three-dimensional forms, sounds, holograms, or a combination of two or more of these elements, used to distinguish goods and/or services produced by individuals or legal entities in commercial activities.
A trademark serves as:
- A distinguishing sign to
differentiate goods or services produced by one party from those of
others;
- A promotional tool, enabling
products or services to be promoted simply by mentioning the trademark;
- A guarantee of quality of the goods
and/or services;
- An indication of origin of the
goods and/or services.
A trademark cannot be registered if it:
- Contravenes state ideology, laws
and regulations, morality, religion, decency, or public order;
- Is identical to, directly related
to, or merely describes the goods and/or services applied for;
- Contains elements that may mislead
the public regarding the origin, quality, type, size, purpose, or use of
the goods and/or services;
- Contains information inconsistent
with the quality, benefits, or characteristics of the goods and/or
services;
- Lacks distinctive character;
- Consists of common names and/or
public symbols.
A trademark application shall be rejected if the trademark:
- Is identical or substantially
similar, in whole or in essential part, to a previously registered
trademark for similar goods and/or services;
- Is identical or substantially
similar to a well-known trademark for similar goods and/or services;
- Is identical or substantially
similar to a well-known trademark for dissimilar goods and/or services,
subject to specific conditions;
- Is identical or substantially
similar to a recognized geographical indication;
- Resembles the name of a well-known
person, photograph, or legal entity owned by another party without written
consent;
- Resembles the name, abbreviation,
flag, emblem, or symbol of a country or a national or international
institution without written consent;
- Resembles official signs, seals, or
stamps used by the State or government institutions without written
consent.
Trademark registration serves as:
- Legal evidence of ownership of the
registered trademark;
- A basis for refusal of identical or
substantially similar trademark applications submitted by other parties;
- A basis for preventing unauthorized
use of identical or substantially similar trademarks in commerce for
similar goods and/or services.
Term of Trademark Protection
A registered
trademark is granted legal protection for a period of ten (10) years from the
filing date and may be renewed in accordance with applicable laws and
regulations.
